TRUSTEE’S SALE NOTICE

WHEREAS, on the 21st day of April, 2023, by deed of trust recorded in the Register’s Office of Perry County, Tennessee, in Book 146, page 797, Christopher Lee Smith and wife, Kristen Eve Smith, conveyed to William E. Bates, Trustee, the hereinafter described real estate to secure the payment of a note therein described; and

WHEREAS, default has been made in payment of said indebtedness and other provisions of the deed of trust have been violated, and the holder of said indebtedness has directed the Trustee to foreclose the deed of trust in accordance with the terms thereof; the public is, therefore, hereby notified that the undersigned Trustee will sell the hereinafter described real estate at public auction to the highest and best bidder for cash,

The property to be sold is located in Perry County, Tennessee, and is more particularly described as follows:

Parcel 3.00:

Beginning on a stake on the West side of Highway No. 100 where said Highway and School Street intersect; thence North 83 degrees West 147 feet to a stake; thence South 3 degrees West 132 feet to a stake in Highway No. 100 right-of-way; thence North 62 degrees East 100 feet with said right-of-way to a stake; thence North 45 degrees East 93 feet to the same to the beginning.

Assessed as Tax Map 76I, Group A, Parcel 3.00, Perry County, Tennessee.

Parcel 4.00:

Beginning on a point at a culvert in the East margin of Oak Street, the Northwest corner of the tract recorded in Deed Book H-10, Page 12, ROPCT, and runs thence with a fence North 88 degrees East 138 feet to the Northwest corner of Perry County Rescue lot; thence South 9 degrees West 85 feet; South 18 degrees West 141 feet to the North margin of School Street; thence with the same, North 86 degrees West 100 feet to the intersection of Oak Street; thence with the East margin of Oak Street North 5 degrees 11 minutes East 207.1 feet to the point of beginning, containing 0.6 acres, more or less, by survey of Thomas E. Lawson, RLS No. 650, and dated April 18, 1988.

Assessed as Tax Map 75L, Group C, Parcel 4.00, Perry County, Tennessee.

Being the same property conveyed to Christopher Lee Smith and wife, Kristin Eve Smith, by Special Warranty Deed of Bank of Perry County, dated April 17, 2023, recorded in Book D41, page 738, in the Register’s Office of Perry County, Tennessee.

Parcel 3.00 of this property is an unimproved tract identified as tax map 76I, group A, parcel 3.00, in the office of the Assessor of Property of Perry County, Tennessee. The street address of the above-described property is believed to be Main St, Linden, Tennessee 37096; but such address is not part of the legal description of the property sold herein, and in the event of any discrepancy, the legal description herein shall control.

Parcel 4.00 of this property is an improved tract identified as tax map 75L, group C, parcel 4.00, in the office of the Assessor of Property of Perry County, Tennessee. The street address of the above-described property is believed to be 217 East School St, Linden, Tennessee 37096; but such address is not part of the legal description of the property sold herein, and in the event of any discrepancy, the legal description herein shall control.

Pursuant to T.C.A. 35-5-104, other parties that may have an interest in the tract of land herein described are the following:

1. Perry County Trustee through unpaid county taxes for 2025 assessed as tax map 76I, group A, parcel 3.00, in the amount of $251.00.

2. Town of Linden through unpaid city taxes for 2025 assessed as tax map 76I, group A, parcel 3.00, in the amount of $54.95; and for 2024 in the amount of $64.02, plus penalty and interest.

3. Perry County Trustee through unpaid county taxes for 2025 assessed as tax map 75L, group C, parcel 4.00, in the amount of $1,512.00; and unpaid county personal property taxes for 2025 in the amount of $17.00.

4. Town of Linden through unpaid city taxes for 2025 assessed as tax map 75L, group C, parcel 4.00, in the amount of $331.32; and unpaid city personal property taxes for 2025 assessed as tax map 75L, group C, parcel 4.00, in the amount of $3.65; and for 2024 in the amount of $3.87, plus penalty and interest.

The sale will be made free from the equity of redemption, homestead, dower and all other rights and exemptions, which were expressly waived under said deed of trust.

Trustee will convey all his right, title and interest, but without warranties of title. The sale will be made subject to any and all encumbrances, including but not limited to unpaid taxes; and I will sell and convey as Trustee and not otherwise.

The sale held pursuant to this Notice may be rescinded at the Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.

Pursuant to TCA §43-14- 201, DUE NOTICE is hereby given that an election will be held February 17, 2026 for three positions on the PerryCounty Soil & Water Conservation District (SWCD) Board. Polling location will be: Perry County SWCD office, 113 Factory St, Linden,from 8am until 4pm CDT. Nominating petition submittal deadline is February 13,2026 by 4pm CST to the SWCD office, at the address above.
